Terms of Use

This English translation is provided for convenience only. The German version is legally binding.

s14.de is an archive and a marketplace for classic BMW. These terms of use govern what applies to everyone here — for reading, for the personal garage, for the marketplace and for editorial contributions. They apply in addition to the Legal Notice and to the Privacy Policy.

1. Operator and scope

The operator of the marketplace is MOTORSPORT24 GmbH, Scharfe Lanke 109–131, Haus 113a, 13595 Berlin (hereinafter “s14.de” or “we”). These terms apply to the entire website s14.de and all its areas — the editorial archive, the model pages, “From the Garage”, the profile pages and the marketplace at s14.de/markt/. They apply to visitors without an account as well as to registered members, sellers and authors. Deviating terms from users do not apply.

2. What s14.de is — and what it is not

s14.de provides the platform: listings, search, watchlist and the contact channel between interested parties and sellers. A purchase or other contract regarding a listed vehicle or part is concluded exclusively between the seller and the interested party. s14.de is not involved in this, is not a party to the contract and does not represent either side.

An exception applies to listings in which MOTORSPORT24 GmbH itself is named as the seller. For these, the terms stated in the listing and in the seller profile apply; the contracting party is then MOTORSPORT24 GmbH.

We review listings before publication and check them for plausibility (see “How we review”). This is an editorial review carried out to the best of our knowledge — not an inspection of the vehicle or part and no guarantee of the accuracy of the information provided. The respective seller is responsible for the content of a listing.

3. Account

• Listing, watchlist and notifications require a free account. Inquiries to sellers are also possible without an account.
• An account may only be created by persons who are of legal age and have unlimited legal capacity. One account is intended per person or company respectively.
• The information provided at registration must be accurate and kept up to date. Commercial sellers must identify themselves as such and keep their company details in the seller profile up to date.
• Login credentials must be kept confidential. Anyone who hands over their account to third parties bears responsibility for what happens through it.
• The account can be terminated at any time — by message to us. Published listings will then be ended; the listing pages remain as an archive in accordance with clause 6, and personal contact channels are removed.

4. Listings: what is allowed and what the seller warrants

The marketplace is oriented toward BMW vehicles and parts of the E-series and older generations. We reserve the right not to publish listings outside this scope.

By creating a listing, the seller warrants that:

• They are entitled to offer the vehicle or part.
• All information — in particular regarding condition, mileage, originality, vehicle identification number, accident history and provenance — is true and complete. Known defects are disclosed. Information the seller does not know with certainty must be marked as uncertain.
• Images and texts originate from the seller themselves, or they hold the rights to use them here. Third-party images, catalogue or press photos without permission are not permitted.
• The price is stated as a final price in Euro. Commercial sellers must correctly indicate differential taxation under § 25a UStG or standard taxation.
• A listing advertises exactly one vehicle or one part (or a related set). Multiple listings of the same offer are not permitted.
• The listing contains no links or references to other sales platforms and no contact details within the body text — contact takes place via the designated channels.

We may editorially revise listings insofar as this serves classification purposes: assignment to the model line and category, standardisation of titles, correction of obvious typos, arrangement of images. The factual content is not changed in the process. There is no entitlement to publication.

5. Approval and review

New listings are reviewed by us before publication. We may ask follow-up questions, require changes or refuse publication, particularly in cases of incomplete information, suspected legal violations or evidently inconsistent data. A review does not replace the interested party’s own inspection prior to purchase.

6. Duration, extension, archive

• A listing initially runs for 90 days. We remind the seller by email in good time before expiry.
• If they do not respond, we extend it once by a further 90 days and inform them accordingly. Any further extension must be carried out by the seller themselves — a click within the account.
• Without extension, the listing is deemed expired. It remains findable in lists and search for a further 180 days, and interested parties can still reach the seller. The seller can reactivate it at any time during this period.
• Afterwards, the listing moves to the archive: it no longer appears in lists and search, but the listing page remains as evidence that this offer existed. The contact channels are removed.
• Sold or reserved offers should be marked as such by the seller promptly. We may mark listings as sold if we become aware of the sale.

7. Inquiries and communication

Interested parties reach sellers via the inquiry form on the listing page. The message is delivered by email; replies are routed via a forwarding address from s14.de until both sides exchange direct contact details. This way, the interested party’s email address remains protected initially, and we can detect misuse and evaluate response times. Further details in the Privacy Policy.

The contact channel serves exclusively to initiate a transaction concerning the respective listing. Advertising, mass inquiries, poaching to other platforms and the collection of contact details are not permitted. Sellers are asked to respond promptly to genuine inquiries — responsiveness may become visible in the seller profile in the future.

8. Watchlist and notifications

Registered users can save listings and, if desired, receive emails upon price changes, reservation or sale of saved listings, as well as about new listings of the same model line (at most one email per day). Each of these notifications can be switched off individually within the account.

9. Costs

Account, listings, inquiries and watchlist are currently free of charge. Should we offer paid services in the future — such as highlighted placements, dealer packages or inspection services — price and scope will be disclosed before booking. Existing free listings will not become chargeable without the seller’s consent.

10. Rights to content

The seller retains all rights to their texts and images. They grant s14.de the simple, temporally and geographically unrestricted right to display the content of the listing on s14.de, to use it for lists, previews, newsletters and posts on social networks, to technically edit it for display (size, crop, format), to translate it into the English version of s14.de, and to preserve it as an archive entry after the end of the listing period. A sale of the content to third parties does not take place.

We may use anonymised data from listings — such as asking prices by model line and condition — for market analyses and articles on s14.de. Drawing conclusions about individual sellers is not possible in this process.

10a. Content submitted outside the marketplace

Anyone who submits a vehicle to “From the Garage”, uploads a profile picture, or provides us with photographs for an article, retains all rights to it. They grant s14.de the same simple, geographically unrestricted right as a seller under clause 10: display on s14.de, use in lists, previews, the newsletter and posts on social networks, technical editing for display (size, crop, format) and translation into the English version of s14.de.

Unlike with the marketplace, this right is revocable. Anyone who wishes to withdraw their photographs may write to us via the Contact Form. We will then remove the affected images from s14.de. The article itself remains in place — its text, its links and its findability are therefore not lost, only the images disappear. Newsletters already sent and posts already published on social networks cannot be retrieved by us.

Anyone submitting photographs warrants that they took them themselves or hold the rights to them, and that any persons depicted have consented to publication. Our editorial team will, upon request, obscure number plates and other details that make individual persons identifiable — please let us know when submitting.

The submitter’s name is stated alongside the image unless they wish otherwise.

10b. Editorial contributions

Members can list vehicles in “From the Garage” and use the marketplace. Writing contributions in the editorial sections — Models & Engineering, Racing & History, Tuners & Special Editions, Market & Values, Scene & Events — is reserved for authors to whom we have granted the corresponding role.

For editorial contributions, the following additionally applies: the author warrants that the text is their own work and does not infringe the rights of third parties. Adopted passages of text and third-party images must be marked as such and credited with their source. We review contributions before publication, edit them, and may reject or withdraw them. There is no obligation to publish.

The author grants s14.de the same rights to their contribution as described in clause 10a, including translation into English. Their name appears alongside the contribution. A fee is only paid if expressly agreed.

11. Prohibited content, suspension

Listings and messages that violate laws or the rights of third parties, concern counterfeit or stolen goods, contain misleading information, disparage others, or have nothing to do with the purpose of the marketplace are not permitted. We may remove such content without prior notice and suspend accounts temporarily or permanently. In cases of suspected criminal offences, we cooperate with the competent authorities.

12. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence, we are liable only for the breach of material contractual obligations, the fulfilment of which is essential for the use of the marketplace, and limited in amount to the foreseeable damage typical for this type of contract.

We assume no liability for the accuracy of listings, the creditworthiness of users, or the handling of transactions between users. Claims arising from a purchase are directed exclusively against the respective contracting party. We make efforts to ensure constant availability of the marketplace but cannot guarantee it; maintenance windows and disruptions are possible.

13. Notices for consumers

Between users of the marketplace, the statutory rules for purchase agreements apply — depending on whether the seller acts privately or commercially. Commercial sellers are themselves responsible for fulfilling their statutory information obligations toward consumers, particularly regarding warranty and right of withdrawal.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

14. Changes to these terms

We may adjust these terms if the functions of the marketplace, the legal situation or our offering change. Users with an account will be informed of changes by email; they are deemed accepted if no objection is raised within four weeks. We will point out this consequence in the notification. In the event of an objection, either side may terminate the account.

15. Final provisions

The law of the Federal Republic of Germany applies. For merchants, legal entities under public law and special funds under public law, Berlin is the place of jurisdiction. Should any provision be invalid, the remainder shall remain valid. The German version is authoritative; the English translation serves to aid comprehension.
